Labor Unions want to gut Right To Work laws

From The National Right To Work Committee:

The Obama Labor Board just declared a full-scale assault upon all 25 state Right to Work laws.

As you know, in March, Wisconsin became the third state in three years to adopt Right to Work. The worker freedom movement is growing, and momentum is on our side.

Now the former union lawyers on Barack Obama's National Labor Relations Board (NLRB) are taking revenge and moving forward with a scheme to gut all 25 state Right to Work laws.

From the outrageous persecution of Boeing for creating jobs in Right to Work South Carolina to ambushing workers with quick-snap unionization elections, the Obama Labor Board has rammed through one union-boss power grab after another.

I've been warning concerned citizens like you for two years that the worst may be yet to come, now that Barack Obama is no longer accountable to the American people.

Thanks to the surrender of a few weak-kneed Republicans in the U.S. Senate in 2013, Barack Obama has a fully-stocked NLRB stacked with a gaggle of union lawyers to do Big Labor's bidding.

And now the Obama Labor Board is seizing that opportunity and preparing to overturn over 60 years of precedent and ignore the plain language of federal and state law.

National Right to Work Foundation staff attorneys identified this threat over a year ago.

United Steelworkers (USW) union bosses in Florida have asked the NLRB for permission to charge fees to workers who exercise their right under Florida law to cut off financial support to a union they don't support.

Foundation staff attorneys filed a brief in the case last June, arguing that this scheme would effectively eviscerate by administrative fiat Section 14(b) of the Taft-Hartley Act, which authorizes state Right to Work laws.

Under the union lawyers' twisted logic, unions in Right to Work states should be able to require independent-minded workers to pay "contract grievance fees."

But by seeking and gaining monopoly bargaining power, union bosses have taken away the individual worker's freedom to represent himself or herself in dealing with the employer.

Not only that, the union controls the entire "contract grievance" process, and individual workers cannot seek any remedies without the union's permission and involvement.

The worker never agreed to the process or the rules -- the union imposed all of it.

Adding insult to injury, union bosses forbid nonmembers from voting on the contact, meaning workers have zero opportunity whatsoever to change the rules or process.

Everything about this system is coercive, and coercion is precisely why Right to Work laws are necessary to protect workers.

Earlier Boards and federal courts have correctly interpreted the law in case after case since 1953, holding that Right to Work laws mean exactly what they say.

Independent-minded workers in Right to Work states don't have to pay a single penny to an organization they did not ask for and do not want.

The Obama NLRB has already signaled its intent to overturn all those precedents and ignore the law's plain language.

"When this board is asking for an amicus brief on the reconsideration of a rule, the majority's already decided that it wants to change the rule," one labor law expert commented.

Foundation staff attorneys are already working on a new brief to dismantle the union lawyers' contrived arguments for this scheme.

But the real battle is likely to be in federal court.

In fact, Foundation staff attorneys are providing free legal aid to an independent-minded worker in Texas in a similar case.

We could be in for another years-long legal battle against this outrageous power grab.

Getting down to the wire

Tomorrow I will force the expiration of the NSA's illegal spying program.

I will not allow any bill extending illegal NSA spying to be rushed through ahead of the deadline.

My oath is to support and defend the Constitution and I won't back down.

The abuse of general warrants and the attack on the Bill of Rights must stop once-and-for-all.

We don't have to choose between fighting terrorism and obeying the Constitution.

That's why, two years ago, I sued the NSA.

It's why I proposed the Fourth Amendment Protection Act to force our government to abide by the Bill of Rights.

It's why I have fought for a full, open and honest debate on warrantless domestic spying -- a debate that is always kicked down the road in the name of "security."

So last week, with the proponents of this illegal spying rushing toward a deadline to ram through renewing illegal spying, I took a stand.

I filibustered for over 10 hours to shine a light on the vast expansion of the spy state and the erosion of our liberties.

I stood on the Senate floor until the early hours of the morning and helped block any short-term extension of these powers.

Tomorrow, the Senate will come back from recess with just hours left before the NSA's illegal spying powers expire.

And I won't allow defenders of the spy state to legislate through a manufactured crisis by holding a deadline over the head of Congress.

Let me be clear: I believe the number one job of the federal government is national defense.

I believe we must fight terrorism and I believe we must stand strong against our enemies.

But we do not need to compromise the Constitution in the process.

In fact, we must not.

I am ready and willing to start the debate on how we fight terrorism without giving up our liberty.

This can't be delayed any longer.

I do not do this to obstruct.

I'm fighting for a strong national defense that upholds the Constitution and protects Americans from enemies who seek to do us harm.

Clinton ally threatens Congressman Trey Gowdy

Congressman Trey Gowdy just received a veiled threat from a close Clinton ally -- suggesting that Gowdy is risking harm.

We knew this moment was coming.

CNN contributor and close Clinton ally, Paul Begala compared Rep. Gowdy to a dog crushed by "5,000 pounds of 1977 Oldsmobile rolling over his head."

Then he said, "If I were Mr. Gowdy, I'd be mighty careful. Hillary has the facts on her side, and I suspect the last thing the Republicans truly want are the facts."

Now we must rally IMMEDIATELY to Stand with Gowdy.

Back Senator Rand Paul this Sunday

Barack Obama effectively labeled me Enemy #1 for refusing to back down on ending illegal NSA snooping, taking what one major news outlet referred to as a direct "swipe" at me and my campaign.

I don't mind a bit.

Midnight Sunday is the line President Obama drew in the sand yesterday when he demanded the U.S. Senate pass the House-approved "reform" bill to keep bulk collection of the American people's phone data going.

I've drawn my line in the sand too. And I'm not backing down.

On Sunday, I'm going to fight to END the NSA's illegal spying program with everything I've got.

Force the unconstitutional Patriot Act to expire

Keep the pressure on to defeat the Patriot Act

What a week!

It all culminated last night around 1:30 AM when the U.S. Senate attempted to ram through legislation to keep the NSA's illegal domestic spy programs alive.

The first vote was on the House passed "reform" bill, which still allows bulk data collection under another method.

It failed, leaving spy-state apologists only one option - to ram through some type of short-term extension of the unconstitutional "Patriot" Act.

I stood up to the surveillance state every step of way.

I refused to back down - objecting to EVERY short-term extension attempt made last night.

As a result, the Senate was forced to adjourn WITHOUT reauthorizing the "Patriot" Act - meaning the beast is set to expire on May 31st.

When the Senate comes back into session next Sunday, they'll have only 8 hours to pass a bill before the "Patriot" Act expires.

That means if you and I can hold the spy state off for only 8 more hours, we'll relegate the NSA's illegal spy program to the trash bin of history where it belongs.

But to do that I'm going to need your help throughout next week.

The truth is, this fight is extremely important to our future.

The Founders understood Liberty cannot long survive without privacy.

Most conservatives know government registration of firearms would ultimately lead to gun confiscation.

It's no different with the rest of our lives.

UCLA study debunked

I’ve warned for years about colleges promoting the radical Homosexual Agenda at the expense of the truth and the Liberal Media.

And a recent paper on homosexual “marriage” in the “Science Magazine” is the latest example.

The UCLA researchers of this study claimed that spending just 30 minutes with a homosexual dramatically increases support for homosexual “marriage.”

The report basically says that opposition to homosexual “marriage” is based on ignorance and not moral or religious beliefs.

Not surprisingly, this widely popular report has now been exposed as false.

You see, the liberal news media wanted this study to be true.

They knew repeating this lie would help break down Real Marriage.

And armed with new findings to continue their anti-Family agenda, Radical Homosexual activists even exploited the study to label Real Marriage supporters as “bigots.”

But now they’re forced to face reality as this so-called “study” was easily proven to be an outright lie.

In a private conversation, the University of California Los Angeles graduate assistant collecting the data admitted to “falsely describing at least some of the details of the data collection.”

And other students failed to produce statistically similar results when they tried to duplicate the study.

Despite his confession and the mounting evidence against the study, the UCLA graduate assistant refused to write a retraction.

The study was finally forced into question when his co-author came forward with the confession, but only after sitting on the false data for an entire year, helping radical homosexuals spread the lie.

I’m outraged, my friend!

As a public school, UCLA used taxpayer funding to pay an employee to fabricate a homosexual hit piece against pro-Family Americans.

This falsehood was even promoted as a major study against Real Marriage supporters.

But in reality, it was nothing more than propaganda designed to artificially drive public opinion against pro-Family Americans.

How many other government funded and pro-homosexual studies are faked to promote the radical Homosexual Agenda?

Radical homosexuals have many ivory tower allies in modern day academia.

And who knows how many times these published studies against Real Marriage relied on false data.

I’ve seen the radical Homosexual Lobby and their allies distort the truth time and time again.

Section 215 update: keep the pressure up

Tonight, we achieved what the conventional wisdom had deemed utterly unfathomable.

There are never any permanent victories in politics — and tonight’s is undoubtedly particularly fragile and must be cradled over days and weeks and months to come.

But the Senate just easily rejected attempts to extend expiring Patriot Act authorities.

No matter what comes next, tonight's vote against the extension of Section 215 represents a victory for democracy over totalitarianism; for open government over secret law; for reasonability over hysteria.

Demand Progress and our members have been at at the forefront of efforts to rein in bulk surveillance since just after our org’s inception four years ago. We have helped organize more than one million actions in opposition to mass spying — including encouraging and facilitating the activism of 250,000 people who support sunsetting Section 215 — over just the last ten days.

Remind Congress to let Section 215 and other unconstitutional provisions retire by exhausting the time limit

Americans were outraged to learn that the NSA has been spying on all of us — and a federal court ruled just a few days ago that this behavior is illegal.[1]

Yet this week Congress stands on the verge of reauthorizing some of the worst parts of the PATRIOT Act for another five years.

Section 215 of the PATRIOT Act — that's the authority that the NSA exploits to collect data about almost all of our phone calls — expires on June 1st. This week and next week Congress will take up legislation to extend it.

Investigations into the phone data collection program have made it clear that it does not make us safer. It's the project of a rogue surveillance agency that makes up its own rules and is never held accountable to the public. It's time to change that.

Telecom lawyers are making the ludicrous argument that the FCC didn't give sufficient notice before making the decision.1

HR 1774, The Compassionate Access Act, reschedules marijuana under federal law to a classification other than Schedule I. Rush Limbaugh Endorses Marijuana

EIB NETWORK OFFICIAL COMMUNIQUE — Controversial Conservative Talk Radio Mogul Rush Limbaugh endorsed medical marijuana legalization on his show Tuesday, and told Internet Chronicle reporters smoking the “Mary Jane” helped him recover after a scandalous opiate addiction. Rush pontificated in front of the golden EIB microphone, “All you listeners out there in flyover country, I know this might scare you a bit, but I wouldn’t have been able to make it through hundreds of shows if it weren’t for the benefits of medical marijuana. When I topped off my cigar with a half gram, all my tremors and cravings for painkillers disappeared. I was able to speak more eloquently than ever, if anything. And when I stopped craving the painkillers, I went back to normal cigars without any withdrawals whatsoever. I know this may come to a shock to some of the people out in the heartland, but Marijuana is a truly miraculous medicine.”

Rush Limbaugh brought Libertarian talk host Neal Boortz onto his show for a discussion about the flaws and merits of legalizing drugs. Rush took the position that mostly harmless and medicinally-oriented drugs like marijuana and possibly MDMA should be legalized, but Boortz pushed for legal recreational use of all drugs. Boortz, exasperated, said “We should be ashamed that we have more prisoners than any other country in the world, and who are we locking up? They’re all drug addicts. They buy and consume drugs. That’ll drive the economy as powerfully as a war, as long as we nationalize the production and retail of the drugs as we do with alcohol and armored humvees. It’s win-win.”

Legislative Strategy Memo

Overview:

As you know, several provisions of the so-called “PATRIOT” Act, including Section 215 (used by the National Security Agency to justify its controversial metadata collection program) sunset at the end of May.

For the reasons outlined below, the upcoming debate on reauthorizing those provisions provides us with a great opportunity to start rolling-back the surveillance state.

At the very least, this battle can enable us to alert more Americans to the dangers of mass surveillance and join our efforts. This is why I believe we must devote as many resources as possible to our “Stop the Surveillance State Banner Bomb.”

Unfortunately, two years after the Snowden revelations we are still getting phony, watered-down reforms from the House. Next week, the House of Representatives will consider the USA FREEDOM Act (USAF). Sponsors of this bill claim that it ends bulk collection and protects our rights.

However, an examination of the details of this bill shows that it does not end warrantless surveillance or bulk data collection.

Phony, Watered-Down Reforms:

USAF simply places some small limitations on the government’s ability to conduct these programs. So at most, the bill will slightly curtail the existing metadata program, assuming the NSA does not find ways to get around even the minor restraints imposed by this bill.

Friday’s Second Circuit Court decision that the NSA’s metadata collection is not authorized by current law may actually make this worse since the court only found the 215 bulk metadata collection program illegal because it lacked statutory authorization.

Passage of the USA Freedom act may thus void the decision by authorizing, for the first time, certain types of bulk metadata collection -- albeit with some “limitations!”

One reason this bill is so weak is that the House leadership told the Judiciary Committee they would not allow any “reform” bill to come to the floor unless the House Intelligence Committee supported it.

As both of you know, the Intelligence Committee is full of the most die-hard supporters of the surveillance state in Congress.

In fact, the current Chairman of the Committee once referred to Justin Amash as “Al-Qaeda’s best friend” because of Representative Amash’s efforts to end mass surveillance.

So the fix was in.

At the Judiciary Committee mark-up, Representative Ted Poe of Texas and Representative Raul Labrador of Idaho both offered amendments that would have provided Americans with real protections from warrantless surveillance.

Both of these amendments were rejected even though many members spoke in favor of them. But those representatives admitted the reason they were voting against the amendment was because they had heard that amending the bill to enact real protections of our liberties would “blow up the deal.”

Senate "Bait and Switch":

In the Senate, the situation is even worse. Senate leadership is attempting to divert our attention away from the flaws in USA FREEDOM Act with a classic “trick play.”

Senate Majority Leader Mitch McConnell has introduced a clean “PATRIOT” Act reauthorization bill extending these provisions until 2020 and placed it directly on the Senate calendar.

However, Senator McConnell is well aware that there are not the votes to pass clean reauthorization in the House, and he likely lacks the votes in the Senate to pass it too.

So why is Senator McConnell doing this? Information I have picked up from both the "inside-the-beltway" media and the conversions with our allies on the Hill indicates that McConnell may be trying to divert attention away from the problems with the USA FREEDOM Act.

Believe it or not (and I know you will both have no problem believing this) many of our inside-the-beltway “allies” are once again falling for McConnell’s trick.

These “leaders” are frankly working to pass the USAF in order to stop McConnell from passing his clean reauthorization bill into law.

They are doing this even though (as I pointed out above) McConnell does not have the votes to pass a clean reauthorization bill.

More importantly, when you examine both proposals, the practical result of passing USAF would be nearly the same as passing McConnell’s bill.

Falling for the “we must pass something bad to avoid getting something worse” is an exceptionally poor strategy since, if Congress does nothing, Section 215 and other PATRIOT Act provisions expire in three weeks.

In other words, all we have to do is keep legislation extending the Sec. 215 program off President Obama’s desk for three weeks and we win!

That is why Campaign for Liberty's “Stop the Surveillance State Banner Bomb” is so important.

Since we are not falling for McConnell's scheme, we are one of the few groups positioned to play a key role in this debate.

If we raise the funds to implement the complete program, we can flood popular websites like Facebook with ads alerting pro-liberty Americans to the upcoming votes and mobilize them to put the heat on Congress.

This will enable us to bury the Senate with petitions demanding Congress reject both the USA FREEDOM Act and any clean reauthorization of the PATRIOT Act.

Battle is in the Senate:

In my discussions on Capitol Hill with friendly and undecided offices, I believe that while we should not totally ignore the House, our best change to defeat the bill is in the Senate.

Tim Shoemaker and I have analyzed the situation in the House and concluded that House leadership is going be able to cobble together a coalition of pro-surveillance members desperate to expand the “PATRIOT” Act and those desperate to "do something" about surveillance but unwilling to fight leadership.

In the Senate, however, one Senator can delay pro-surveillance legislation giving us time to build support against any phony “reform” bill and take advantage of the sunsetting provisions to either force the Senate to allow the Sec. 215 and other provisions to expire or pass real anti-surveillance legislation.

As you know, Rand has already said he will oppose USA FREEDOM, a straight reauthorization bill, or any other legislation that allows the NSA to continue to spy and snoop on innocent Americans without a warrant.

All we need to do is convince a handful of senators to vote with Rand and we can block any pro-surveillance state legislation from passing the Senate and reaching President Obama’s desk.

Of course, our success ultimately depends on us getting the support of our members to fully implement the “Stop the Surveillance State Banner Bomb.”

It’s vital our members understand the importance of fully funding the “Stop the Surveillance State Banner Bomb” by making their most generous contribution of $30 , $20 , or $10 .

Black judge revictimizes white child

Kentucky Judge Rips Into “Racist” Toddler

From time to time, someone will wonder idly why there really isn’t a market for conservative political comedy. Why isn’t there a right-wing equivalent of Jon Stewart, for instance? And when someone does pop up, why aren’t they able to really break into the mainstream?

It’s an interesting question, but the answer may be a simple one. Good satire relies on being able to make piercing observations sprinkled with just a touch of exaggeration. With the right comic sensibilities, you gently nudge the absurd into the outrageous. Nudge too far, and it veers into stupidity. Nudge too little, and the comedy loses its edge. But when everything you have to work with is already outrageous, where is there to go?

How do you make this funny, for instance?

Kentucky Judge Olu Stevens, himself a black man, decided recently to use his judicial power to launch into a disgusting tirade against the racism of a three-year-old victim of armed conflict. Stevens was presiding over a case in which two armed black men (not to be confused with the unarmed variety we hear so much about) broke into the home of Jordan and Tommy Gray in March 2013. The men – Gregory Wallace and Marquis MacAfee – found the Gray’s toddler watching Spongebob Squarepants on TV. That didn’t stop them. They wielded their guns, robbed the Grays under threat of death, and escaped. They were arrested weeks later, and MacAfee was sentenced to ten years in the clink.

Wallace, however, is another story, and it was during his sentencing phase that Judge Stevens took exception to something the Grays wrote in their victim impact statement.

“Whenever we are running errands, if we come across a black male, she holds me tight and begs me to leave,” wrote Jordan Gray. “It has affected her friendships at school and our relationships with African-American friends.”

In other words, as one might expect, this little girl’s encounter with a life or death situation has had a significant impact on her psyche.

But no, says Judge Stevens, that’s not the problem. “I am offended,” he said at Wallace’s sentencing hearing in February. “I am deeply offended that they would be victimized by an individual and express some kind of fear of all black men.” He went on to slam the parents for “accepting that kind of mentality and fostering those type of stereotypes.” Putting the cherry on top, he let Wallace off with probation.

Not certain that he had gotten his point across, Judge Stevens took his ill-advised rant to

Facebook. “Do three year olds form such generalized, stereotyped and racist opinions of others?” he wrote online. “I think not. Perhaps the mother had attributed her own views to her child as a manner of sanitizing them.”
Surprisingly, this is not even the first time this year that a black person of note has accused a toddler of racism. Just last month, Indiana Democrat Vanessa Summers took to the floor of the State House of Representatives to insist that her colleague’s 18-month-old was scared of her because of her race. “I have told Representative McMillin I love his little son, but he’s scared of me because of my color,” Summers mused. “And that’s horrible.”

We’ve traded common sense in this country, built up through thousands of years of civilization, for politically-correct, pop psychology nonsense. It was one thing when that crap was fodder for the Oprah Winfreys and Tumblr users of the world. Now, though, it has come to darken our classrooms, our politics, and even our courtrooms.

And even the world’s most gifted comedian would have a hard time seeing anything funny about that.

Big Cable files lawsuits against the FCC

Tell Congress to rein in NSA spying

It's illegal.

That's what the New York-based 2nd Circuit U.S. Court of Appeals unanimously said about the NSA's bulk collection of American phone records earlier this morning.

As I've stated since the very beginning, the NSA's program of collecting billions of innocent Americans' phone records, texts, emails, Internet searches, and social media posts is blatantly unconstitutional.

The Founders included the Fourth Amendment in the U.S. Constitution to protect Americans' right to privacy from government snooping.

But the court didn't even need to address the program's constitutionality!

Please join me in taking our country back by adding your name right away.

While spy-state apologists point to the so-called "PATRIOT Act" as the source for legal authorization, the court noted the bill does nothing of the sort!

The entire scheme is flat-out ILLEGAL. Period.

If our government used the legal tools it has to target terrorists -- instead of sifting through innocent Americans' information -- we could fight terrorism and uphold the Constitution.

But it's going to take a President who is willing to take the oath to uphold the Constitution seriously.

I ran for office because I feared the Washington machine was out of control.

I believed it was time for true patriots -- not career politicians -- to stand up and stop the madness.

Bad news and good news on TPP

Bad news first: Fast Track legislation to ram through the Trans-Pacific Partnership (TPP) has now passed out of committee in both the U.S. House and Senate, and it’s moving fast.

Now the good news: just last week the House Majority Leader admitted that “the votes aren’t there yet” to get this anti-democratic, censorship-enabling legislation passed.1

But both the Obama administration and corporate-backed Republican leadership are working together to spread propaganda and claim there is “nothing secret” in the TPP – while the entire text is still classified!2 Worse, they are literally bribing reps with a fancy dinner if they vote for the Fast Track bills.3

The vote is going to be painfully close. Every second counts and every voice matters. Will you speak out today?
