Help fight Garland's bid for the Supreme Court

Barack Obama is plotting to cripple the fight to protect worker freedom by installing Merrick Garland, a Big Labor approved justice on the Supreme Court.

Observers believe the Supreme Court could take up the case again as soon as next year.
But if Republicans wilt under Big Labor's pressure campaign, Garland is very likely to vote with the Court's four liberal justices to deliver a gut-punch to the worker freedom movement.

Recently, liberal law professors bragged that a pro Big Labor Supreme Court majority could rule Right to Work itself as unconstitutional.
And now, one Wisconsin judge just handed the nation a peek at the future of Right to Work if Barack Obama gets his way and installs a pro-Big Labor nominee on the Supreme Court.
The judge's ruling struck down the state's Right to Work law by agreeing with Big Labor's lawyers that the state of Wisconsin cannot protect employees from union bosses who threaten to have them fired for refusing to pay dues or fees to a union they don't support.
If Barack Obama's union label nominee, Merrick Garland, is confirmed to the Supreme Court, I'm afraid his record proves he could very well cast the deciding vote to eliminate Right to Work laws across the country.
His 20 year record on the D.C. Court of Appeals reveals his Big Labor bias.
In fact, in two cases he sided against workers represented by the National Right to Work Legal Defense Foundation.
He even voted to gut the Supreme Court's decision in the Beck case, which allows workers to opt-out of paying the portion of their dues that funds union politics.
And AFL-CIO President Richard Trumka heaped praise upon Garland and called his pro-Big Labor credentials "impeccable."
That's why I was so disturbed by the news some Republicans might be faltering on their commitment to block Garland's nomination.

Don't let Obama gut right to work laws

Just last week, West Virginia became the fourth state in four years to adopt Right to Work. The worker freedom movement is growing, and momentum is on our side.
But the lawyers on Barack Obama's National Labor Relations Board (NLRB) are taking revenge with a scheme to gut all 26 state Right to Work laws.
From the outrageous persecution of Boeing for creating jobs in Right to Work South Carolina to ambushing workers with quick-snap unionization elections, the Obama Labor Board has rammed through one union-boss power grab after another.
I've been warning concerned citizens like you for two years that the worst may be yet to come, now that Barack Obama is no longer accountable to the American people.
Thanks to the surrender of a few short-sighted Republicans in the U.S. Senate in 2013, Barack Obama has a fully-stocked NLRB stacked with a gaggle of union lawyers to do Big Labor's bidding.

End union violence
From The National Right To Work Committee:
Armed with phony protest signs attached to baseball bats along with other "concealed" makeshift weapons, more than 500 International Longshore and Warehouse Union (ILWU) militants stormed the port in Longview, Washington.
Slashing tires, breaking windows, cutting the brake lines of fully loaded railway cars, dumping shipments of grain into the dirt, the ILWU mob slowly made their way to a group of six port security guards determined to stop their march.
Outnumbered, the guards were quickly forced to retreat into their guard shack where they were held hostage until the police were finally able to restore order.
If any other common criminals were to destroy property and hold people hostage, they would be put behind bars where they belong.
Yet, not one of these union thugs was arrested!
But the shocking thing is: Stories like this one, even though they don’t make national news, are repeated again and again.
That’s why I hope you will immediately sign the petition I've created to your U.S. Senators and Majority Leader Mitch McConnell.

You see, you and I have an opportunity to ultimately put an end to this kind of union violence.
The fact is, for nearly 40 years union bosses and their enforcers have committed thousands of reported incidents of violence, extortion, vandalism and even murder -- and untold thousands more that go unreported.
And in virtually every case, these vicious acts of violence and intimidation have gone unpunished.
That’s because of the Supreme Court’s infamous 1973 Enmons decision which granted union bosses immunity from prosecution under federal law for acts of violence and vandalism orchestrated in the so-called "pursuit of legitimate union objectives."
This outrageous loophole in federal law has effectively tied the hands of law enforcement and has permitted union bosses and their handpicked "enforcers" to use any means necessary to achieve their often violent goals.

In the Longview case, at least no one was shot.
Unfortunately, John King, the owner of a mid-size Toledo electrical contracting business, wasn’t so lucky when he was shot by a union thug in the dead of night.
You see, Mr. King’s business had been a regular target for a union boss takeover by the International Brotherhood of Electrical Workers (IBEW).
They nearly succeeded, that is until the U.S. Court of Appeals overturned the IBEW’s certification after it was shown that the union bosses lied to King’s employees, promising them electrician jobs on union sites if they voted the union into his company.
At that point, the IBEW’s "corporate campaign" of harassment, vandalism and death threats returned with a vengeance.
King, along with his employees, was the regular target of union militants who would routinely slash the tires of their cars and throw rocks through the company’s windows.
As King put it: "It was nothing to have to regularly buy a new set of tires . . . the ice pick was the weapon of choice."
Then things turned uglier when the IBEW militants turned their attention not to King’s company, but this time to his home.
Late one night while getting ready for bed, King noticed the motion lights turn on in his driveway.
When he went out to investigate, he was confronted by a union thug who had just finished spray painting the word "SCAB" across King’s SUV and was set to puncture his tires.
When King yelled, the man didn’t say a word. Instead he stood up, and without hesitation pulled out a gun and shot King.
Fortunately, Mr. King lived. Others have not been so lucky.
That’s why I hope you will join our effort to make sure union bosses are held accountable for the acts of violence they commit.
But to do this, your help is crucial.
The fact is, union violence reflects Big Labor’s coercive approach to organizing. Instead of relying on persuasion, union officials have routinely resorted to threats and compulsion to add to their dues-paying ranks.
Richard Trumka, the AFL-CIO’s president, is a case in point.
When asked about union violence, Mr. Trumka coldly replied: "I’m saying if you strike a match and put your finger in it, you’re likely to get burned."

Support the National Right To Work Act

The 2016 Presidential Election campaigns are at full stride, and the start of the Congressional races is not far behind.
Airwaves will resound with politicians and talking heads, expounding on what ails our country.
But there is one issue they all too often fail to mention -- a policy that holds back our economy, corrupts our political system and punishes working Americans just trying to live out the American dream . . .
. . . Compulsory Unionism.
You see, in 1935, politicians in Washington, D.C. bestowed on Big Labor the raw power to compel working men and women to pay tribute to a union boss just to work and feed their families.

National Labor Relations Board bullies workers

The radical Obama Labor Board is at it again -- trapping workers under unwanted union monopoly control.
Dissatisfied with United Auto Workers (UAW) Local 3066 union bosses, a group of battery plant workers in South Carolina recently circulated a petition to remove the unwanted union from their workplace.
After a majority of workers signed the petition, the employer agreed to withdraw recognition of the union.
The National Labor Relations Board (NLRB) General Counsel deemed the workers' petition invalid and demanded that the UAW be brought back into the plant.
But the independent-minded workers were determined to remove the unwanted union and took the only other step available to them.
They exercised their right to request a secret-ballot election.
UAW union lawyers again cried foul, and the NLRB General Counsel again complied with their demands to block the secret-ballot vote.
Rather than let workers vote privately and let their true desire be heard, the rogue agency is colluding with union bosses to trap employees in an unwanted union.
These workers simply sought to exercise their workplace rights, and instead have fallen victim to NLRB policies that trample the rights of employees in an effort to protect union bosses from accountability from the workers they claim to "represent."
The Obama NLRB has made it a standard operating procedure to make removing an unwanted union as difficult as possible.
You may remember that earlier this year, the Obama NLRB subjected workers in Alabama to FIVE decertification elections to remove an unwanted union from their workplace.
Your Foundation stood with them every step of the way and ensured that their true voices were heard, and we will continue to fight on behalf of these South Carolina workers.

Should the National Right To Work Committee fight on or give up?

What makes this scheme so egregious is that workers ensnared in monopoly bargaining agreements are practically prohibited from dealing directly with their employers or hiring their own representation when they have an issue to be resolved.
The rules virtually force them to use the union-controlled grievance apparatus.
Now the NLRB plans to require workers to pay for this so-called service -- which workers are compelled to use .
And this so-called “grievance fee” can equal or exceed the amount of union dues.
Through this scheme, workers who have broken free from the shackles of compulsory unionism could be cast back into Big Labor's iron grip.

Labor Unions want to gut Right To Work laws

The Obama Labor Board just declared a full-scale assault upon all 25 state Right to Work laws.
As you know, in March, Wisconsin became the third state in three years to adopt Right to Work. The worker freedom movement is growing, and momentum is on our side.
Now the former union lawyers on Barack Obama's National Labor Relations Board (NLRB) are taking revenge and moving forward with a scheme to gut all 25 state Right to Work laws.
From the outrageous persecution of Boeing for creating jobs in Right to Work South Carolina to ambushing workers with quick-snap unionization elections, the Obama Labor Board has rammed through one union-boss power grab after another.
I've been warning concerned citizens like you for two years that the worst may be yet to come, now that Barack Obama is no longer accountable to the American people.
Thanks to the surrender of a few weak-kneed Republicans in the U.S. Senate in 2013, Barack Obama has a fully-stocked NLRB stacked with a gaggle of union lawyers to do Big Labor's bidding.
And now the Obama Labor Board is seizing that opportunity and preparing to overturn over 60 years of precedent and ignore the plain language of federal and state law.
National Right to Work Foundation staff attorneys identified this threat over a year ago.
United Steelworkers (USW) union bosses in Florida have asked the NLRB for permission to charge fees to workers who exercise their right under Florida law to cut off financial support to a union they don't support.
Foundation staff attorneys filed a brief in the case last June, arguing that this scheme would effectively eviscerate by administrative fiat Section 14(b) of the Taft-Hartley Act, which authorizes state Right to Work laws.
Under the union lawyers' twisted logic, unions in Right to Work states should be able to require independent-minded workers to pay "contract grievance fees."
But by seeking and gaining monopoly bargaining power, union bosses have taken away the individual worker's freedom to represent himself or herself in dealing with the employer.
Not only that, the union controls the entire "contract grievance" process, and individual workers cannot seek any remedies without the union's permission and involvement.
The worker never agreed to the process or the rules -- the union imposed all of it.
Adding insult to injury, union bosses forbid nonmembers from voting on the contact, meaning workers have zero opportunity whatsoever to change the rules or process.
Everything about this system is coercive, and coercion is precisely why Right to Work laws are necessary to protect workers.
Earlier Boards and federal courts have correctly interpreted the law in case after case since 1953, holding that Right to Work laws mean exactly what they say.
Independent-minded workers in Right to Work states don't have to pay a single penny to an organization they did not ask for and do not want.
The Obama NLRB has already signaled its intent to overturn all those precedents and ignore the law's plain language.
"When this board is asking for an amicus brief on the reconsideration of a rule, the majority's already decided that it wants to change the rule," one labor law expert commented.
Foundation staff attorneys are already working on a new brief to dismantle the union lawyers' contrived arguments for this scheme.
But the real battle is likely to be in federal court.
In fact, Foundation staff attorneys are providing free legal aid to an independent-minded worker in Texas in a similar case.
We could be in for another years-long legal battle against this outrageous power grab.

Oppose forced unionism

It’s vital that you do so at once.
You see, every year your National Right to Work Committee surveys its members to make sure our programs line up with your priorities.
This year, with Obama appointees at the Federal Election Commission (FEC) and the Internal Revenue Service (IRS) emboldened to use any bureaucratic weapon in their arsenal to shut down your National Right to Work Committee, your participation is more important than ever.
When I last wrote to you warning of the threat posed by the Obama FEC and IRS, the response from Committee members was an overwhelming: "Fight On!"
As I explained, the FEC and IRS union boss water-carriers could bury your Right to Work Committee under a mountain of harassing subpoenas over our efforts to inform opponents of forced-unionism which Senators and Congressmen support Right to Work . . .
. . . And which ones don’t.
In the past, Big Labor’s cronies at the FEC have concocted rules which refuse to recognize that you are a "real" member of the National Right to Work Committee.
They have repeatedly insisted that you aren’t entitled to the same rights under the U.S. Constitution accorded to members of other organizations.
From what my attorneys tell me, the Committee’s position will be strongest if as many members as possible certify each year that they currently consider themselves to be members of the National Right to Work Committee.
As you know, the FEC bureaucracy attacked the Committee for exposing corruption involving candidates for federal office and top-level union officials.
That’s why your 2015 Membership Ballot -- demonstrating that we do have members -- may be essential in fighting off any retaliatory legal challenges to our membership.
Can you please take a few minutes to complete your 2015 Membership Ballot?
Completing your Membership Ballot is also very important for another reason.
In the next few weeks, I face some big decisions and I need your advice.
As you well know, in recent years, you and I have fought many battles with forced-unionism advocates in state legislatures and in Congress.
Right to Work supporters in Indiana and Michigan overcame Big Labor’s forced-dues-fueled leviathan and passed Right to Work laws, restoring to workers in these states the right to earn a living without having to pay dues and fees to a union boss.
And in Wisconsin, Big Labor took a huge hit when the state become America's 25th Right to Work state.
Then just think about the national battles you and I have had with Big Labor in the last several years.
Time and again, Card Check Forced-Unionism -- Big Labor’s favorite tool to corral workers into dues-paying ranks -- has reared its ugly head in Congress and in bureaucratic rule-making.
And let’s not forget the efforts of Right to Work members to force roll-call votes in the U.S. House and Senate on our National Right to Work Act.
Through petitions and postcards, phone calls, e-mails and letters to their Congressmen and Senators, opponents of forced-unionism have fought Big Labor’s forced-dues power.
Then in recent election years, you and folks like you mobilized a Right to Work citizen army to turn up the heat on candidates before the elections, demanding they pledge total opposition to forced-unionism.
And just look at what happened last year . . .
. . . Eight new pro-Right to Work Senators replaced forced-dues advocates, some of whom represented Big Labor’s interests for decades.
Now it’s up to you and me to build on our successes and move forward with the plan to put every member of Congress on record for or against compulsory unionism.
Unfortunately, as I try to budget for 2015, your National Right to Work Committee accounts have been drained -- first from our efforts to secure roll-call votes on the National Right to Work Act and then from last year’s massive 2014 Issue Education and Mobilization Program.
So I need your advice on allocating the Committee’s funds.
Should I emphasize a campaign for federal legislation rolling back Big Labor’s forced-unionism power in Congress?
Or should protecting and advancing Right to Work in the states be top priority?
Or should your Committee try to fight both nationally and on the state level?
Let me explain my dilemma.
With Right to Work gains in both the U.S. House and Senate, now is the time to put every member of Congress on record on the forced-unionism issue by forcing a roll-call vote in both Houses of Congress on the National Right to Work Act.
As you know, a National Right to Work law would mean that no worker could be forced to join or pay dues to a labor union just to get or keep a job.
And just getting a roll-call vote would be a win/win scenario for opponents of compulsory unionism.
After all, every time in the past five decades that Big Labor’s pet politicians have been exposed to the nearly 80% of Americans who think forced union dues are just plain wrong, they have gone down in flames at the ballot box.
And 2016 could be an even worse year for forced-dues advocates than 2014.
That’s why I believe you and I must do everything we can to FORCE Congress to go on record for or against the National Right to Work Act.
But this fight won’t be easy -- or cheap.
So I’m counting on your support, and your advice.
You see, in addition to battles in Congress, Right to Work supporters face some tough challenges as well as tremendous opportunities on the state level.
In addition to protecting Right to Work laws in Wisconsin, Michigan, Indiana, Iowa and Nevada, now is the time to use our momentum to extend Right to Work to other states like Kentucky, Montana, New Mexico, New Hampshire and Maine, as well as in a host of other states where the political climate is ripe for freeing workers from the shackles of forced-unionism.
The fact is, after years of hard work, two states, Indiana and Michigan, became Right to Work states in 2012 -- something that hasn’t happened since 1954!
If two states deep in the heart of the union boss dominated Rust Belt can pass Right to Work, I’m confident other states can as well.
So, should I emphasize a federal campaign, concentrating on forcing a roll-call vote on the National Right to Work Act?
Or should going on offense to pass new state Right to Work laws be our top priority?
Or should the Committee try to fight both nationally and on the state level?
Now, I’m sure you agree that it’s vital you and I do everything we can to put all members of Congress on record for or against forced-unionism.
So, if you think our federal legislative program should take priority, mark "FEDERAL LEGISLATION" on your Membership Ballot.
But before you do, give some thought to what’s at stake in the state legislatures.
Shouldn’t you and I strike while the iron is hot in states where it may be possible to pass Right to Work laws?
But we can’t leave current Right to Work states undefended in order to gain new ones.
So should defending state Right to Work laws and working to end forced-unionism in promising states be a top priority?
If you think so, mark "STATE LEGISLATION" on your ballot.
I’m sure you can see why I’m torn . . .
. . . And why I’m writing to ask you for your advice -- and, I hope, for your increased financial support.
Unless I can generate a major influx of funds at the beginning of this year, I will be forced to cut back on both federal and state legislative programs.
The fact is, with the tremendous opportunities you and I have in the current political climate, abandoning the field now would be heartbreaking.
With 11 million American workers shouldering Big Labor’s yoke, you and I cannot give up the fight now.

This year, with Obama appointees at the Federal Election Commission (FEC) and the Internal Revenue Service (IRS) emboldened to use any bureaucratic weapon in their arsenal to shut down your National Right to Work Committee, your participation is more important than ever.
When I last wrote to you warning of the threat posed by the Obama FEC and IRS, the response from Committee members was an overwhelming: "Fight On!"
As I explained, the FEC and IRS union boss water-carriers could bury your Right to Work Committee under a mountain of harassing subpoenas over our efforts to inform opponents of forced-unionism which Senators and Congressmen support Right to Work . . .
. . . And which ones don’t.
In the past, Big Labor’s cronies at the FEC have concocted rules which refuse to recognize that you are a "real" member of the National Right to Work Committee.
They have repeatedly insisted that you aren’t entitled to the same rights under the U.S. Constitution accorded to members of other organizations.
From what my attorneys tell me, the Committee’s position will be strongest if as many members as possible certify each year that they currently consider themselves to be members of the National Right to Work Committee.
As you know, the FEC bureaucracy attacked the Committee for exposing corruption involving candidates for federal office and top-level union officials.
That’s why your 2015 Membership Ballot -- demonstrating that we do have members -- may be essential in fighting off any retaliatory legal challenges to our membership.

Completing your Membership Ballot is also very important for another reason.
In the next few weeks, I face some big decisions and I need your advice.
As you well know, in recent years, you and I have fought many battles with forced-unionism advocates in state legislatures and in Congress.
Right to Work supporters in Indiana and Michigan overcame Big Labor’s forced-dues-fueled leviathan and passed Right to Work laws, restoring to workers in these states the right to earn a living without having to pay dues and fees to a union boss.
And in Wisconsin, Big Labor took a huge hit when the state become America's 25th Right to Work state.
Then just think about the national battles you and I have had with Big Labor in the last several years.
Time and again, Card Check Forced-Unionism -- Big Labor’s favorite tool to corral workers into dues-paying ranks -- has reared its ugly head in Congress and in bureaucratic rule-making.
And let’s not forget the efforts of Right to Work members to force roll-call votes in the U.S. House and Senate on our National Right to Work Act.
Through petitions and postcards, phone calls, e-mails and letters to their Congressmen and Senators, opponents of forced-unionism have fought Big Labor’s forced-dues power.
Then in recent election years, you and folks like you mobilized a Right to Work citizen army to turn up the heat on candidates before the elections, demanding they pledge total opposition to forced-unionism.
And just look at what happened last year . . .
. . . Eight new pro-Right to Work Senators replaced forced-dues advocates, some of whom represented Big Labor’s interests for decades.
Now it’s up to you and me to build on our successes and move forward with the plan to put every member of Congress on record for or against compulsory unionism.
Unfortunately, as I try to budget for 2015, your National Right to Work Committee accounts have been drained -- first from our efforts to secure roll-call votes on the National Right to Work Act and then from last year’s massive 2014 Issue Education and Mobilization Program.
So I need your advice on allocating the Committee’s funds.
Should I emphasize a campaign for federal legislation rolling back Big Labor’s forced-unionism power in Congress?
Or should protecting and advancing Right to Work in the states be top priority?
Or should your Committee try to fight both nationally and on the state level?
Let me explain my dilemma.
With Right to Work gains in both the U.S. House and Senate, now is the time to put every member of Congress on record on the forced-unionism issue by forcing a roll-call vote in both Houses of Congress on the National Right to Work Act.
As you know, a National Right to Work law would mean that no worker could be forced to join or pay dues to a labor union just to get or keep a job.
And just getting a roll-call vote would be a win/win scenario for opponents of compulsory unionism.
After all, every time in the past five decades that Big Labor’s pet politicians have been exposed to the nearly 80% of Americans who think forced union dues are just plain wrong, they have gone down in flames at the ballot box.
And 2016 could be an even worse year for forced-dues advocates than 2014.
That’s why I believe you and I must do everything we can to FORCE Congress to go on record for or against the National Right to Work Act.
But this fight won’t be easy -- or cheap.
So I’m counting on your support, and your advice.
You see, in addition to battles in Congress, Right to Work supporters face some tough challenges as well as tremendous opportunities on the state level.
In addition to protecting Right to Work laws in Wisconsin, Michigan, Indiana, Iowa and Nevada, now is the time to use our momentum to extend Right to Work to other states like Kentucky, Montana, New Mexico, New Hampshire and Maine, as well as in a host of other states where the political climate is ripe for freeing workers from the shackles of forced-unionism.
The fact is, after years of hard work, two states, Indiana and Michigan, became Right to Work states in 2012 -- something that hasn’t happened since 1954!
If two states deep in the heart of the union boss dominated Rust Belt can pass Right to Work, I’m confident other states can as well.
So, should I emphasize a federal campaign, concentrating on forcing a roll-call vote on the National Right to Work Act?
Or should going on offense to pass new state Right to Work laws be our top priority?
Or should the Committee try to fight both nationally and on the state level?
Now, I’m sure you agree that it’s vital you and I do everything we can to put all members of Congress on record for or against forced-unionism.
So, if you think our federal legislative program should take priority, mark "FEDERAL LEGISLATION" on your Membership Ballot.
But before you do, give some thought to what’s at stake in the state legislatures.
Shouldn’t you and I strike while the iron is hot in states where it may be possible to pass Right to Work laws?
But we can’t leave current Right to Work states undefended in order to gain new ones.
So should defending state Right to Work laws and working to end forced-unionism in promising states be a top priority?
If you think so, mark "STATE LEGISLATION" on your ballot.
I’m sure you can see why I’m torn . . .
. . . And why I’m writing to ask you for your advice -- and, I hope, for your increased financial support.
Unless I can generate a major influx of funds at the beginning of this year, I will be forced to cut back on both federal and state legislative programs.
The fact is, with the tremendous opportunities you and I have in the current political climate, abandoning the field now would be heartbreaking.
With 11 million American workers shouldering Big Labor’s yoke, you and I cannot give up the fight now.
So can I count on you to chip in with a contribution NOW equal to or even larger than $10?
