We have some dire news to share. This morning, President-Elect Trump announced his pick for Attorney General and it couldn’t be much worse for the marijuana law reform movement and our recent legalization victories.

Trump’s pick, Alabama Senator Jeff Sessions, is a militant prohibitionist. We could go into great detail about how Senator Sessions has been an outspoken opponent of reform for decades, but in this case his rhetoric is so off the wall...we’ll let his past statements speak for themselves:

It was the prevention movement that really was so positive, and it led to this decline. The creating of knowledge that this drug is dangerous, it cannot be played with, it is not funny, it's not something to laugh about, and trying to send that message with clarity, that good people don't smoke marijuana.

Lady Gaga says she's addicted to (marijuana) and it is not harmless.

You have to have leadership from Washington. You can't have the President of the United States of America talking about marijuana … you are sending a message to young people that there is no danger in this process. It is false that marijuana use doesn't lead people to more drug use. It is already causing a disturbance in the States that have made it legal.

His former colleagues testified Sessions used the n-word and joked about the Ku Klux Klan, saying he thought they were "okay, until he learned that they smoked marijuana."

Senator Sessions is clearly off the reservation on this one and is diametrically opposed to the overwhelming public opinion which stands in favor of the legalization and regulation of marijuana. With the authority the position of Attorney General provides, Sessions could immediately get to work attempting to block the implementation of the recent ballot initiatives, start dismantling a legal industry in Washington, Colorado, Oregon, and Alaska, and begin conducting massive raids on existing medical and recreational retail stores.
We must be ready to fight back. We must be ready to mobilize in defense of all of our hard fought victories. We already have our opponents calling for a recount in Maine and prohibitionists in Massachusetts working to gut core provisions like home cultivation from their state's initiative. With an assist from a newly minted prohibitionist Attorney General, things might get worse before they get better.

The Mexican government is mounting a rushed effort to turn as many of their former citizens into American citizens as they can ahead of the November elections. Terrified that Donald Trump could make it much harder for Mexican immigrants to wantonly disregard our laws, the country is opening up their consulates in Chicago, Dallas, and elsewhere to permanent U.S. residents who are eligible for citizenship. And though Mexican officials insist that they are not trying to interfere with the internal affairs of a sovereign country, it is fairly obvious that they want as many Mexicans voting against Trump as they can get.

Laura Espinosa, deputy consul in Mexico’s consulate in Las Vegas, said the main goal of the program is citizenship, and while that includes the right to vote, the government doesn’t press people to do so. “Those who use this to vote, that’s up to each individual,” said Espinosa, who confirmed that most consulates have begun citizenship campaigns. “We don’t have any opinion on that, because that would be totally interfering in internal affairs of the country.”
Oh, is the right to vote included in this? My, we had no idea!

The movement to turn immigrants into voters isn’t the only thing Mexico is doing to make sure they keep those remittance dollars rolling in for decades to come. They are also rolling out a PR campaign designed to let Americans know everything Mexicans have done “in business, the arts, and academia in the U.S.” According to Paulo Carreno, who is overseeing the marketing campaign, the goal is less about the 2016 election and more about influencing “a whole generation and those that follow.”

That Mexico is working this hard to oppose Trump should tell American voters something. Why would a sovereign country (whose immigration laws, mind you, are much less forgiving than ours) be so desperate to make sure their citizens can move out? Doesn’t that say something about what’s going on here?

Oh, but this is all about opposing white racism, right? Of course it is.

Republicans have done a terrible job at countering the leftist narrative that says a strong border is akin to bigotry and xenophobia. It’s almost like they believe it themselves. This party is constantly on the defensive. They use phrases like “we just…” Whatever happened to strong conservatives who could stand for the rule of law without sounding as though they’re ashamed of their own policies? Are Ted Cruz and Donald Trump the only ones capable of that?

It's with a heavy heart that I type this. I would have loved a Cruz Presidency. If he were born on vacation in Minnisota there would be no problem but as it stands there is just no way. What we have seen from the Holder DOJ is the most corrupt department of the federal government ever. Corruption like this has not been seen for over 50 years. For two centuries there has been bipartisan agreement that American democracy depends on free speech. Alas, more and more, the modern Democratic Party has abandoned that commitment and has instead been trying to regulate the speech of the citizenry.

We have seen President Obama publicly rebuke the Supreme Court for protecting free speech in Citizens United v. FEC; the Obama IRS inquire of citizens what books they are reading and what is the content of their prayers; the Federal Communications Commission proposing to put government monitors in newsrooms; and Sen. Harry Reid regularly slandering private citizens on the Senate floor for their political speech.

But just when you thought it couldn't get any worse, it does. Senate Democrats have promised a vote this year on a constitutional amendment to expressly repeal the free-speech protections of the First Amendment.

You read that correctly. Forty-one Democrats have signed on to co-sponsor New Mexico Sen. Tom Udall's proposed amendment to give Congress plenary power to regulate political speech. The text of the amendment says that Congress could regulate "the raising and spending of money and in-kind equivalents with respect to federal elections." The amendment places no limitations whatsoever on Congress's new power.

Two canards are put forth to justify this broad authority. First, "money is not speech." And second, "corporations have no free speech rights."

Neither contention bears even minimal scrutiny. Speech is more than just standing on a soap box yelling on a street corner. For centuries the Supreme Court has rightly concluded that free speech includes writing and distributing pamphlets, putting up billboards, displaying yard signs, launching a website, and running radio and television ads. Every one of those activities requires money. Distributing the Federalist Papers or Thomas Paine's "Common Sense" required money. If you can prohibit spending money, you can prohibit virtually any form of effective speech.

As for the idea that the Supreme Court got it wrong in Citizens United because corporations have no First Amendment rights, that too is demonstrably false. The New York Times is a corporation. The television network NBC is a corporation. Book publisher Simon & Schuster is a corporation. Paramount Pictures is a corporation. Nobody would reasonably argue that Congress could restrict what they say—or what money they spend distributing their views, books or movies—merely because they are not individual persons.

Proponents of the amendment also say it would just "repeal Citizens United" or "regulate big money in politics." That is nonsense. Nothing in the amendment is limited to corporations, or to nefarious billionaires. It gives Congress power to regulate—and ban—speech by everybody.

Indeed, the text of the amendment obliquely acknowledges that Americans' free-speech rights would be eliminated: It says "[n]othing in this article shall be construed to grant Congress the power to abridge the freedom of the press." Thus, The New York Times is protected from congressional power; individual citizens, exercising political speech, are not.

If this amendment were adopted, the following would likely be deemed constitutional:

Congress could prohibit the National Rifle Association from distributing voter guides letting citizens know politicians' records on the Second Amendment.

Congress could prohibit the Sierra Club from running political ads criticizing politicians for their environmental policies.

Congress could penalize pro-life (or pro-choice) groups for spending money to urge their views of abortion.

Congress could prohibit labor unions from organizing workers (an in-kind expenditure) to go door to door urging voters to turn out.

Congress could criminalize pastors making efforts to get their parishioners to vote.

Congress could punish bloggers expending any resources to criticize the president.

Congress could ban books, movies (watch out Michael Moore) and radio programs—anything not deemed "the press"—that might influence upcoming elections.

One might argue, "surely bloggers would be protected." But Senate Democrats expressly excluded bloggers from protection under their proposed media-shield law, because bloggers are not "covered journalists."

One might argue, "surely movies would be exempt." But the Citizens United case—expressly maligned by President Obama during his 2010 State of the Union address—concerned the federal government trying to fine a filmmaker for distributing a movie criticizing Hillary Clinton.

One might argue, "surely books would be exempt." But the Obama administration, in the Citizens United oral argument, explicitly argued that the federal government could ban books that contained political speech.

The contemplated amendment is simply wrong. No politician should be immune from criticism. Congress has too much power already—it should never have the power to silence citizens.

Thankfully, any constitutional amendment must first win two-thirds of the vote in both houses of Congress. Then three-fourths of the state legislatures must approve the proposed amendment. There's no chance that Sen. Udall's amendment will clear either hurdle. Still, it's a reflection of today's Democratic disrespect for free speech that an attempt would even be made. There was a time, not too long ago, when free speech was a bipartisan commitment.

John Stuart Mill had it right: If you disagree with political speech, the best cure is more speech, not less. The First Amendment has served America well for 223 years. When Democrats tried something similar in 1997, Sen. Ted Kennedy was right to say: "In the entire history of the Constitution, we have never amended the Bill of Rights, and now is no time to start."

Michael Reagan on Rand Paul

MICHAEL REAGAN: Rand Paul Gets It

I disagree with some of Rand Paul’s more libertarian positions, especially on social issues. And I’m certainly not endorsing him or anyone else to be the Republican nominee for president at this time. But Sen. Paul of Kentucky did two things recently that won my favor.

He showed the 2,500 conservative activists at the CPAC conference last weekend that he understands what the GOP must do if it wants to take the Senate this fall and win back the White House.

And then on Monday he wrote a good column for Breitbart.com calling for his fellow Republican presidential wannabes to, as the headline said, “Stop warping Ronald Reagan’s foreign policy.”

CPAC, as all conservatives and political junkies know, is the annual bathing beauty competition for every Republican who’s ever had a daydream about running for president.

Sen. Paul’s brand of libertarian-leaning conservatism has shifted the GOP’s center of gravity his way and everyone at CPAC knew it.

He was the landslide winner in the straw poll, taking 31 percent of the vote. Ted Cruz stumbled in second with 11 percent and neurosurgeon Ben Carson had 9 percent. The media’s favorite conservative, Chris Christie, managed 8 percent.

At CPAC Sen. Paul had a personal victory, but he also did the right thing for the GOP. He went out of his way to give his full support to fellow Kentucky Sen. Mitch McConnell, who’s up for reelection.

It wasn’t because Sen. Paul is moving to the McConnell center of the GOP, it was because he wants his party to win the U.S. Senate in the fall.

A Republican Senate is Prize Number One. Making friends and cementing cracks in the party is what’s most important right now and Sen. Paul understands that side of the equation.

In his Breitbart column he did two good things. He reminded his more bellicose fellow presidential competitors that their hero Ronald Reagan was a peacemaker and a negotiator, not a war-maker.

Saying he admired Ronald Reagan because he “was not rash or reckless with regard to war,” Sen. Paul pointed out that my father, who believed in “Peace Through Strength,” was attacked harshly by the hawks in the Republican Party.

He was called an appeaser for meeting with Mikhail Gorbachev in Iceland and for pulling American forces out of Lebanon after 241 Marines died in the suicide bombing there in 1983.

In his column Sen. Paul also told conservative Republicans something else they need to remember — something I’ve spent half my life preaching and he has been practicing.

Sen. Paul wrote that he doesn’t claim to be the next Ronald Reagan and will not engage in disparaging his fellow Republicans for “not being sufficiently Reaganesque.”

But, he said, no doubt thinking of Sen. Ted Cruz, “I will remind anyone who thinks we will win elections by trashing previous Republican nominees or holding oneself out as some paragon in the mold of Reagan, that splintering the party is not the route to victory.”

Splintering itself is something the GOP has become really good at doing.

The 2012 presidential primary was a cluster suicide mission for conservative Republicans, which is why Moderate Mitt was the last candidate standing.

Then, because 25 percent of evangelicals stayed home in November rather than vote for Romney, we ended up with “The Obama Horror, Part 2.”

Liberals speak with one voice. Conservatives are a squabbling family of factions — social conservatives, economic conservatives and libertarian conservatives.

But if conservatives of all stripes want the GOP to win in 2016 they have to come together and pick their best candidate early, then let the party moderates fight among themselves and split their votes.

That’s what happened in 1980. My father was the only conservative in the primary and he got to watch as the George H.W. Bush moderates and Rockefeller Republicans beat each other up and split their votes.

That’s the way it should work in 2016 — after the GOP takes the Senate.

Reagan was great on foreign policy however when he came to domestic policy he sucked royally especially with the war on drugs which in reality was the war on the Constitution.
