Federal prosecutors cannot punish two Northern California marijuana growers for violating U.S. drug laws because Congress has protected pot suppliers who follow the state’s medical marijuana law, a federal appeals court ruled Friday.
In a 2-1 ruling, the Ninth U.S. Circuit Court of Appeals in San Francisco upheld a federal judge’s decision that two men whose property in Humboldt County was raided by federal drug agents in 2012 had complied with California’s medical marijuana law and could not be sentenced as drug dealers under federal law.
Both men had pleaded guilty to federal charges in 2014, a year before Congress barred the Justice Department from spending money to interfere with a state’s medical marijuana law. California voters approved the nation’s first such law in 1996, and 20 years later approved another law legalizing possession, use and cultivation for personal use of marijuana by adults over 21.
The appeals court had ruled in a separate case in 2016 that the budget restriction prohibited federal prosecution of growers who could prove they were following the state’s medical marijuana law. A year later, U.S. District Judge Richard Seeborg cited that ruling to bar federal sentencing of the two marijuana growers, the first such decision in the nation. Their lawyer, Ronald Richards, said Friday’s decision was the first by a U.S. appeals court to prohibit federal marijuana prosecution under the congressional restrictions.
“People are still going to prison for marijuana offenses, notwithstanding the fact that most states have medical marijuana laws and many states have legalized marijuana,” Richards said. “This ruling paves the way for others to challenge these prosecutions and not have the decision upset by an appellate court reweighing the evidence.”
He said his clients, Anthony Pisarski and Sonny Moore, would ask Seeborg to withdraw their guilty pleas.
The Justice Department did not immediately respond to a request for comment. Federal policy on the issue has varied under both the Obama and the Trump administrations. Then-Attorney General Jeff Sessions announced in January 2018 that his office would resume federal marijuana prosecutions nationwide regardless of state laws, but his successor, William Barr, promised at his Senate confirmation hearing in January 2019 that he would not prosecute growers who complied with state marijuana laws.
Pisarski and Moore were arrested in July 2012 by officers who said they found 327 marijuana plants, along with two loaded guns and $416,000 in cash on their property in a remote area of central Humboldt County. Searches over the next year uncovered more firearms, cash, and gold and silver bars.
The two men presented evidence that they grew the marijuana for nearby nonprofit collectives, which reimbursed them for their costs, and that they were abiding by the state law’s ban on growing marijuana for profit. Federal prosecutors argued that the cash, gold and silver were evidence of a profit-making business, but Seeborg disagreed, noting that such transactions were often made in cash because banks refused to serve marijuana businesses.
Upholding his ruling, the appeals court said prosecutors had not presented any evidence of past or future marijuana sales by the growers, other than the legal transactions with the collectives.
“The presence of weapons and excessive amounts of cash on the Humboldt property was equally consistent with the operation of a rural, cash-intensive enterprise as it was with an unlawful marijuana operation,” said Judge M. Margaret McKeown in the majority opinion. She was joined by Judge Eugene Siler of the federal appeals court in Cincinnati, temporarily assigned to the Ninth Circuit.
Dissenting Judge J. Clifford Wallace said the cash, guns and ammunition were evidence of a for-profit operation that would have violated California law.

Congress still hasn't resolved the question of whether to extend the provision through next year, but they did just pass a temporary bill prolonging the protections until December 9.

Net Neutrality wins in court

Victory in the Senate

And THANKS to those efforts, earlier today, a bipartisan majority of the U.S. Senate, 53-44, voted in favor of Audit the Fed!
While we were unable to reach the 60-vote threshold needed to break the filibuster launched by Fed allies like Sherrod Brown (OH), Elizabeth Warren (MA), and Janet Yellen's favorite Republican, Bob Corker (TN), having a majority in the Senate is quite a victory!
And this is only the beginning. Even before the vote was completed, your Campaign for Liberty staff was preparing a two-pronged campaign to make Audit the Fed a huge issue in the upcoming elections, and forcing politicians to either pass Audit the Fed this year... Or face a sea of angry voters in the fall.
Prong one is to go back to the House, and push for a new vote there to pass Audit the Fed. Remember, the House voted overwhelmingly on September 17, 2014 to Audit the Fed, 333-92. That will set the table for another showdown in the Senate, with election day looming.

Federal judge tell the DOJ to back off raiding medical marijuana dispensaries
Medical Marijuana Dispensaries Win Battle Against Federal Crackdown
"This is a big win for medical marijuana patients and their providers."
Medical marijuana dispensaries scored a major win on Monday when a federal judge ruled that the Department of Justice cannot prosecute legal providers of medical cannabis.
In his ruling, Senior District Judge Charles R. Breyer lifted an injunction against a California dispensary, the Marin Alliance for Medical Marijuana, and its founder, Lynette Shaw, ruling that a budget amendment Congress approved last year requires the federal government to respect state marijuana laws. The DOJ is thus precluded from criminally prosecuting organizations like MAMM that comply with state regulations.
The amendment, sponsored by Reps. Dana Rohrabacher (R-Calif.) and Sam Farr (D-Calif.), was added to last year's federal spending bill. Under the provision, the Justice Department is prohibited from using federal funds to undermine state medical marijuana programs. The Rohrabacher-Farr amendment came in response to a renewed federal crackdown on the medical marijuana industry in California, where medical pot has been legal since 1996. MAMM, located in Fairfax, California, was one of the targeted dispensaries, and shuttered in 2011 under federal pressure.
However, the Justice Department has narrowly interpreted the amendment, telling the Los Angeles Times in April that the new restrictions don't apply to dispensaries or individuals, but instead prevents the feds from "impeding the ability of states to carry out their medical marijuana laws."
The amendment's authors vehemently disagreed, accusing the DOJ of violating the law and calling for an investigation into the department's crackdown on legal businesses.
Monday's ruling struck a blow to the DOJ's interpretation of the law, which Breyer said "tortures the plain meaning of the statute."
"It defies language and logic for the Government to argue that it does not 'prevent' California from 'implementing' its medical marijuana laws by shutting down these same heavily-regulated medical marijuana dispensaries," Breyer wrote. "And contrary to the Government's representation, the record here does support a finding that Californians' access to legal medical marijuana has been substantitively impeded by the closing of dispensaries, and the closing of MAMM in particular."
The decision could have wide-ranging implications, as 23 states plus the District of Columbia have legalized pot for medical use. Another 17 states have allowed the use of non-psychoactive cannabis extract to treat conditions like severe epilepsy in children.
Marijuana advocates applauded Breyer's ruling Tuesday.
"This is a big win for medical marijuana patients and their providers, and a significant victory in our efforts to end the federal government’s war on marijuana. Federal raids of legitimate medical marijuana businesses aren’t just stupid and wasteful, but also illegal," said Dan Riffle, director of federal policies for Marijuana Policy Project, in a statement.
"It's great to see the judicial branch finally starting to hold the Justice Department accountable for its willful violation of Congress's intent to end federal interference with state medical marijuana laws,"said Tom Angell, chairman of the pro-legalization group Marijuana Majority. "I hope the Obama administration takes this ruling to heart and makes sure DEA and federal prosecutors finally stop trying to stand between patients and their medicine."
Shaw, MAMM's founder, also praised the ruling.
"I'm very happy and I’m very relieved that I will get to return to my life’s work,” she told the San Francisco Chronicle.

His efforts were bolstered two years ago with Edward Snowden’s revelations about the NSA’s domestic surveillance programs.
And because of your support, today those efforts paid off - and authority for the NSA's illegal spying program will expire tonight at midnight.
This is perhaps one of the greatest victories in my entire political career.
Tonight's victory, however short-lived it may ultimately be, gives me great hope about the future of liberty in this country.
If there's one thing the statists now know for sure - it's that our R3VOLUTION is alive and well - and stronger than ever.
But the surveillance statists are currently regrouping - and tomorrow they'll be back working to water-down the USA FREEDOM Act further to continue the NSA’s lawlessness.
It’ll be up to you and me to demand better than what we’re being asked to settle for.
Regardless of the outcome, the fact that you and I are here is something to be proud of.
My staff is scrambling tonight to better understand exactly what to expect tomorrow and the remainder of the week.

I watched this on CSPAN2 and let me tell you Senator John McCain is one fucked up son of a bitch. He wouldn't yield the floor to Senator Rand Paul and Senator Chuck Grassley presiding wasn't much better. Fortunately Senator Rand Paul was able to take to the floor however the statists were talking amongst themselves so loud the speaker had to tell them to shut up three times. Rand Paul schooled these fools on the Constitution and that we can have security and not trample on the civil liberties of the people. Rand Paul and most of all We The People prevailed today. It is literally Senator Rand Paul and We The People versus the rest of the Senate. Maybe Senator Ron Wyden and Senator Martin Heinrich were exceptions but that is it. In Rand Paul's corner is the Constitution and very large group of angry protesters that let the statists know that we will back Senator Rand Paul all the way. I'm sure the statists noticed them considering they were outside the Senate so they had to see them on the way in. I'm sure that served as a wake up call.

Fortunately Senator Rand Paul was able to take to the floor however the statists were talking amongst themselves so loud the speaker had to tell them to shut up three times. Rand Paul schooled these fools on the Constitution and that we can have security and not trample on the civil liberties of the people. Rand Paul and most of all We The People prevailed today. It is literally Senator Rand Paul and We The People versus the rest of the Senate. Maybe Senator Ron Wyden and Senator Martin Heinrich were exceptions but that is it. In Rand Paul's corner is the Constitution and very large group of angry protesters that let the statists know that we will back Senator Rand Paul all the way. I'm sure the statists noticed them considering they were outside the Senate so they had to see them on the way in. I'm sure that served as a wake up call.

Section 215 update: keep the pressure up

But the Senate just easily rejected attempts to extend expiring Patriot Act authorities.
No matter what comes next, tonight's vote against the extension of Section 215 represents a victory for democracy over totalitarianism; for open government over secret law; for reasonability over hysteria.
Demand Progress and our members have been at at the forefront of efforts to rein in bulk surveillance since just after our org’s inception four years ago. We have helped organize more than one million actions in opposition to mass spying — including encouraging and facilitating the activism of 250,000 people who support sunsetting Section 215 — over just the last ten days.
This most recent effort has been as part of a broad coalition of organizations, including the Bill of Rights Defense Committee, Color of Change, CREDO Action, Daily Kos, Democrats.com, Fight for the Future, Free Press, Left Action, The Nation, The Other 98%, RH Reality Check, RootsAction, and Win Without War.
Now, without further action by the Congress, the authority the NSA exploits to spy on most Americans’ phone calls will expire when the calendar turns to June 1st.
It’s still technically possible for Congress to extend the expiring provisions, but the opportunity grows narrower with each passing day and with each extra person who speaks out against doing so.

Michigan's version of the gay bill of special rights goes down in flames

The Homosexual Lobby's radical agenda crashed into a brick wall in Michigan.
All thanks to your Public Advocate and our pro-Family supporters!
Just last week, Michigan's version of the Gay Bill of Special Rights -- dubbed the Pedophile Protection Act due to its far-reaching implications -- failed to gain enough support in the House Commerce Committee to even warrant a vote.
That makes it a dead bill when Michigan's lame duck session comes to a close.
But this is just a small part of the story.
This pro-Family victory was the result of months of Public Advocate's hard work and our thousands of supporters on the ground in Michigan.
Public Advocate issued hard-hitting pro-Family surveys to every candidate for state office before November's elections -- nearly 350 individuals!
Key battleground House Districts were targeted for additional advocacy; such as postcards, automated phone calls, local activist meetings, and even leafleting.
Representatives from three of these targeted districts were on the Commerce Committee -- and when the time came to debate this despicable bill, they had learned the importance of opposing it.
We also faced off against the entire Homosexual Lobby in one key district over an open seat.
The Homosexual Lobby publicly bragged they would defeat the pro-Family candidate running there who completed our Family Values Survey 100%.
We gave the voters of that district the real story of the Homosexual Lobby, their agenda, and what their candidate had in mind for Michigan.
And the people rallied around the pro-Family choice.
The November elections saw the Homosexual Lobby lose in almost every open race for the state House and Senate.
Due to these defeats, they have no chance of controlling this legislature in the next session.
That's why they were desperate to ram their bill through during Lame Duck.
And that's why it was so crucial for Public Advocate's supporters to step up for Traditional Values and Religious Liberties.
For an entire month, Public Advocate's supporters answered our calls to action.
They flooded the state capitol with phone calls and emails.
Two of the biggest targets in Lansing were Speaker of the House Jase Bolger and State Representative Frank Foster, the two leading Republican supporters of the Pedophile Protection Act (PPA).
Both received massive payouts from anti-Family radicals Tim Gill and Paul Singer this summer.
And both have faced the pro-Family backlash for their betrayal.
Frank Foster actually lost his primary bid for re-election to another candidate who returned our survey 100% pro-Family.
And Speaker Bolger was forced to offer up a Michigan Religious Freedom Restoration Act (RFRA) in an effort to buy support for his radical bill.
Public Advocate's grassroots efforts were so effective that while the PPA died in Frank Foster's Commerce Committee, the RFRA sailed right through the House!
To sum up the Homosexual Lobby's defeat in Michigan, 2014:
•Wasted over $150,000 buying candidates who were rendered powerless or even removed from office,
•Lost a key House race in which they focused national efforts and resources,
•Failed to gain control of either the state House or Senate -- and even lost influence there,
•Defeated in the legislative fight to see their bill (PPA) passed out of Committee, let alone out of the House,
•Lost the war for public opinion as the people of Michigan widely turned against them,
•Failed to prevent the Religious Freedom Restoration Act from passing the House in place of the PPA,
•Were crushed at every point by Public Advocate's 'David' to their 'Goliath.'

Bill for gay special rights is stalled and on life support

Public Advocate has just shut down the Homosexual Lobby's best chance to ram the Gay Bill of Special Rights through the lame duck Congress.
Now, their hopes of passing the crown jewel of their radical agenda before Republicans officially take back the Senate are on life support.
Their plan was to use the same trick they used to pass the Thought Control Act -- a fight you and I lost.
But Public Advocate sounded the alarm several weeks ago about the Homosexual Lobby's scheme.
So I set to work mobilizing our pro-Family supporters to target the key lynchpin in this fight: Republican leadership in the House of Representatives.
And in the last month, Public Advocate flooded leadership's offices with over 30,000 petitions demanding they hold the line against the radical Homosexual Agenda.
Thanks to this groundswell of pro-Family voices, a crucial House committee rejected the Homosexual Lobby's attempt to hide the Gay Bill of Special Rights as part of a critical national defense bill with a 7-3 party line vote.
I'm confident that if you and I had stayed on the sidelines in this fight, the outcome would have been much different.

Congress cuts funding for NSA spying

You did it! Late last night -- after they were bombarded by calls from FFTF members and many others -- the U.S. House of Representatives overwhelmingly voted to cut funding for some of the NSA’s most nefarious backdoor spying programs.
There’s no question about it. The tides are turning. We didn’t just win this vote, we won it by a landslide. 293-123.
Our movement is showing it’s power, and organized Internet users are once again proving to be a more formidable force than the U.S. government (or any of the pundits) expected.

We still have a long way to go. No matter what happens in Congress, we will need to continue our Reset the Net effort to secure the web through technology. As we know all too well, governments often bend and break the rules they set for themselves, and so far the reforms on the table in Congress don’t do nearly enough to protect the rights of people outside the U.S.
But one thing is certain: we are gaining ground, and the NSA is losing it. We’re beating them back with technology, pushing politicians to cut their funding, and dragging their secretive programs out into the sunlight for all to see.
This vote in congress didn't happen by magic. So many of us have spoken out in the last year and made it clear in no uncertain terms that mass surveillance is not okay. Our movement has become too big for Congress to ignore. We forced them to go on record supporting change.

The IRS will now delay new regulations that would have stifled your free speech rights.
After months of deliberations, the IRS plans to go back to square one and start over on their anti-political speech regulations. Due to the incredible volume of comments you submitted, the bureaucrats at the tax agency were forced to halt their plans. They had no choice but to listen to the voice of the people.

The day we fought back was a tremendous success

Tuesday was amazing. Working with scores of organizations, and thousands of sites, and hundreds of thousands of activists, we organized the largest online privacy protest ever.
Nearly 100,000 calls were placed to Congress on that day, melting the phone lines and making it clear that we will persist in the fight to end mass surveillance.
And please share them widely, so the whole world knows just how strong we are when we work together:
On Tuesday we sought to make a dent, while laying a foundation for escalation over the months to come: It was a tremendous success.

Tuesday was amazing. Working with scores of organizations, and thousands of sites, and hundreds of thousands of activists, we organized the largest online privacy protest ever.
Nearly 100,000 calls were placed to Congress on that day, melting the phone lines and making it clear that we will persist in the fight to end mass surveillance.
