Top Senate Democrat Pushes Bill To End Marijuana Prohibition

In one of the clearest signs yet that the politics of marijuana are rapidly shifting in favor of those who support legalization, one of Congress's most vocal longtime proponents of the war on drugs is filing legislation to end federal cannabis prohibition.

Democratic Senate Minority Leader Chuck Schumer of New York announced on Thursday that he will soon introduce a bill to remove marijuana from the Controlled Substances Act altogether so that states can set their own policies.

"The legislation is long overdue," he said in an interview with VICE News. "I've seen too many people's lives ruined because they had small amounts of marijuana and served time in jail much too long."

The news comes on the same day that Sen. Bernie Sanders (I-VT) joined two other potential 2020 Democratic presidential candidates in sponsoring even more far-reaching marijuana legislation.

That bill, the Marijuana Justice Act, would not only exempt cannabis from the Controlled Substances Act, but would also withhold funding from states that have racially disparate marijuana enforcement rates.

“With this announcement, Senator Schumer has effectively made it clear that a legislative priority for the Democratic Party is to end the federal prohibition of marijuana," Justin Strekal, political director of NORML, said. "As Democratic Leader, it is his role to ensure that the caucus as a whole falls in line with this public policy position -- a position that is held by more than 60 percent of Americans."

Schumer's bill would also "create some funding for minority and women-owned marijuana businesses, provide money for research into overall effects of marijuana and its specific effect on driving impairment," VICE News reported.

In 2004, Schumer was recognized by the Partnership for a Drug-Free America as a "Guardian of a Drug-Free America" for his work on drug enforcement legislation. In 2011 he sought to crack down on Bitcoin, seeing it as facilitating illegal drug transactions on the Internet.

Schumer first showed signs he was shifting away from his support for outright cannabis prohibition in 2014, when he said during an MSNBC interview that he supported letting states enact their own marijuana laws without federal interference.

Describing states as “laboratories,” he said, "I think having the states experiment is a good idea.”

The next year, in 2015, he started turning that talk into action by signing on as a cosponsor of legislation to allow states implement their own medical cannabis laws without federal interference.

Earlier this year, the Democratic Senate leader criticized the move by U.S. Attorney General Jeff Sessions to rescind Obama-era guidance that has generally allowed states to implement marijuana legalization policies.

By removing the drug from the Controlled Substances Act altogether, a process known as descheduling, states will be free to set whatever marijuana laws they want, and people following those laws will be protected from federal intervention as long as their cannabis activity doesn't cross state lines or violate local policies.

Schumer also told VICE News that he has no problem supporting legalizing marijuana on the state level in New York.

“My personal view is legalization is just fine,” he said. “The best thing to do is let each state decide on its own.”

But Strekal, of NORML, said that simply ending criminalization isn't enough, and that communities harmed by the drug war should be able to benefit from the newly legal economy.

“As states start dialing back their war on marijuana consumers, it is important that those who were impacted by this oppressive prohibition are able to see previous harms remedied, and be provided the opportunity to participate in the benefits that come along with legalization and regulation," he said.

While I am not a fan of excluding white males this is a start and with Schumer leading the charge for the Democrats to legalize marijuana this is a tremendous boost. Trouble brewing for the establishment

Marco Rubio is no conservative

The strategy of Marco Rubio, Hillary Clinton, and Chuck Schumer and the Gang of 8 to support liberal immigration policies would make our country dramatically less safe. They seem to want to put American troops on the ground in the Middle East, but are unwilling to secure our borders here at home.

Rubio’s liberal immigration policies are bad for conservatives, bad for our country, and most importantly, bad for our nation’s security.

That is why Rand fought for an amendment that would’ve allowed Congress to have more oversight on immigration and further scrutinize those allowed in the country to keep America safer. Marco Rubio blocked this amendment, and other conservative amendments because of a backroom deal with liberal Senator Chuck Schumer.

This critical issue is now becoming even more important because of the Paris attacks and the Syrian refugee crisis. Rubio’s liberal immigration policy puts our country even more at risk.

And it gets even worse. Rubio even wanted these refugees to come into our country without Rand’s immigration security amendment.

Here is what National Review said:

In September, Rubio told a South Carolina town hall audience, “We would be potentially open to the relocation of some of these individuals at some point in time to the United States.” But the prospect that terrorists could use the refugee crisis to smuggle themselves into the United States was obvious in September, as was the fact that there is no system of vetting available to us that could mitigate that risk.

Rubio has expressed support for allowing the refugees into our country, opposed Rand’s amendment to strengthen the security measures in immigration policy, and cut a backroom deal with Chuck Schumer to oppose conservatives. This should forever preclude conservatives from supporting Marco Rubio.

We can trust Rand to stand strong for conservative principles, and make decisions that will make our country safer here at home.

The Senate wants to give the Department of Justice the authority to decide who gets First Amendment protection

Senate Amendment Would Give DOJ Power to Determine Who Is a 'Journalist'

An amendment is moving through the Senate Judiciary Committee that would essentially allow the government to determine who is a journalist for purposes of legal protection of sources. For purposes of protecting a source, a “journalist” under law would be anyone who:

•Works or worked for “an entity or service that disseminates news or information by means of newspaper; nonfiction book; wire service; news agency; news website, mobile application or other news or information service…news program; magazine or other periodical…or through television or radio broadcast…” These people would have to have the “primary intent to investigate events and procure material in order to disseminate to the public news or information.” Opinion journalists might not be covered.

•Bloggers and citizen journalists – citizens who commit acts of journalists without working for such an outlet – would not be covered, unless it was determined that “at the inception of the process of gathering the news or information sought, had the primary intent to investigate issues or events and procure material in order to disseminate to the public news or information.” In other words, the government – the Department of Justice – would now determine whether primary intent was news distribution or political concerns.

•Those explicitly excluded from protection include those “whose principal function, as demonstrated by the totality of such person or entity’s work, is to publish primary source documents that have been disclosed to such person or entity without authorization.” Glenn Greenwald, please contact your lawyer.

Who would decide who fell within these guidelines? A “judge of the United States” can “exercise discretion to avail the persons of the protections of this Act.” But in the first instance, the DOJ would have the discretion to determine whether a person is a “journalist” for purposes of the law. Instead of focusing on acts of journalism, the law would identify people by employment status.

Sen. Sheldon Whitehouse (D-RI) said that it should not matter to citizen journalists if new protections extended to a special class of journalists created by the government, since the First Amendment does not grant any right to protect sources in the first place. “When we’re discussing the issue of adding a privilege, the issue of taking away someone’s First Amendment rights just isn’t engaged….All we’re doing is adding privilege to existing First Amendment rights, so there is, logically, zero First Amendment threat out of this,” said Whitehouse, ignoring the fact that a massive institutional advantage would be handed to approved government outlets, thereby perverting the entire system of a free press.

Sen. Mike Lee (R-UT) launched into the proposed bill, which he said could “have the effect of excluding certain persons from enjoying the added First Amendment protections the bill would provide.” Sen. Ted Cruz (R-TX) agreed, stating, “Essentially as I understand this amendment, it protects what I would characterize as the ‘corporate media.’…But it leaves out citizen bloggers….I don’t think any protection should treat citizen bloggers who are meeting the underlying test of being primarily engaged in gathering news to report it I don’t think they should be excluded because they don’t happen to work for a media corporation.” He continued:

It strikes me that we are on dangerous territory if we are drawing distinctions that are treating some engaged in the process of reporting and journalism better than others. If we are advantaging those who happen to receive a paycheck from a corporate media entity over those who happen to be citizens….I for one would have deep troubles with legislation from Congress saying ‘we will grant special privileges if you happen to work for a corporate media interest’….It seems to me the First Amendment protects the activity, not the employment status of the person engaging in it.
