The Marijuana Industry Pulls Victory From the Jaws of a DEA Defeat

Despite the DEA's failure to reschedule marijuana, the cannabis industry has plenty of positives to look forward to.

August began with plenty of promise for the marijuana industry, but those high hopes went up in smoke on Aug. 11, when the U.S. Drug Enforcement Agency released its long-awaited decision on whether it would reclassify marijuana.

The DEA denies the marijuana industry a victory

For months, the marijuana industry, cannabis supporters, and medical patients had hoped that the U.S. regulatory agency, with the recommendation of the Department of Health and Human Services, would reschedule marijuana from its current status of Schedule 1 -- which deems it an illicit drug with no accepted medical use -- to Schedule 2. This would have recognized that cannabis has an accepted medical benefit, and it would have allowed physicians around the country to prescribe medical marijuana to patients with very specific ailments.

However, the decision by the DEA denied the two petitions seeking to reschedule the still-illicit drug. The DEA leaned on three points in its explanation of the decision.

First, the DEA believes marijuana has a high potential for abuse. Both the evaluation from the Department of Health and Human Services and the DEA's own observations appeared to confirm that.

Second, the DEA pointed out that cannabis has no currently accepted medical use, listing five reasons why that is. Most notably, the drug's chemistry isn't known and reproducible, and there are no well-controlled studies to back up cannabis supporters' claims that it can treat pain, epilepsy, or any other number of ailments.

Finally, the agency believes marijuana lacks an acceptable safety profile. Without any approved cannabis products, the benefits of marijuana don't appear to outweigh its risks.

For these reasons, marijuana will continue to remain a Schedule 1 drug, and approvals at the medical and recreational level will still be conducted at the state level. The ruling took the wind out of the sails of supporters.

But the marijuana industry succeeds anyway

However, it's not all bad news for the cannabis industry. The DEA's decision came with one notable caveat that will allow for easier access into medical marijuana research. Currently, the only approved grow farm in the U.S. is in Mississippi. New regulations could open the door for researchers to gain easier access to cannabis for medical research. Presumably, the sooner researchers can present a series of well-controlled studies on cannabis to the Food and Drug Administration and/or the DEA, the better chance they'll have of getting the latter to reclassify marijuana in the future.

Even more recently, on Aug. 16, the Ninth Circuit Court of Appeals ruled in favor of the cannabis industry by protecting legal recreational and medical marijuana users against federal prosecution. In effect, the 3-0 verdict by the federal court prevents the federal government from providing funding for the prosecution of recreational or medical marijuana users in states where recreational or medical marijuana is legal. With nine states set to vote on whether to legalize cannabis this November, millions of Americans could soon be protected from federal prosecution, according to this ruling. It should be noted that the Appeals Court could change its mind at any time. But for the time being, federal prosecutors will have better ways to spend their money than prosecuting consumers who are using marijuana in accordance with their states' laws.

There's also a bright side to the DEA's decision. Had the DEA rescheduled cannabis, the substance could have been exposed to a laundry list of FDA regulations. For example, the FDA could have placed requirements on packaging and marketing, or it could have demanded consistent levels of THC from each crop of marijuana. Even more importantly, FDA oversight may have forced the cannabis industry to run clinical trials in order to demonstrate the efficacy of the drug for treating certain ailments. These added costs could have put smaller players out of business and essentially handed the industry over to bigger businesses. Given less competition and more regulation, legal marijuana prices would likely rise rapidly.

In other words, marijuana's DEA defeat is, in many ways, a victory.

The lone loser of the DEA decision

Perhaps the biggest loser here is the individual investor looking to take advantage of the marijuana industry's incredible growth.

According to ArcView Market Research, a cannabis research firm, legal marijuana sales hit $5.4 billion in 2015, and they're slated to grow by roughly 30% per year throughout the remainder of the decade. If this trend were to continue, then legal marijuana sales would total nearly $22 billion by 2020. An investment that could grow at 30% per year for five straight years is a real rarity for stock investors, so you can imagine how closely some investors are watching the marijuana industry. Unfortunately, keeping cannabis as a Schedule 1 substance will probably keep big business from gaining substantial market share within the industry. This leaves investors little to no opportunity to profit from the growing legal marijuana market.

Making matters worse for investors is the fact that the vast majority of publicly traded marijuana stocks are penny stocks that trade on over-the-counter exchanges. While reporting standards are improving on the OTC exchanges, it can still be difficult to get accurate financial information on cannabis stocks. Nonetheless, losses remain common among marijuana stocks, and that's all the more reason to watch the advancement of the industry safely from the sidelines.

Legal Marijuana: Why the States Are Loosening The Leash

It appears we’re witnessing the marijuana industry’s transition out of the experimental phase. With only a few actual, accessible legal markets in the United States, marijuana – though attractive and promising – has been viewed with a high level of skepticism by both lawmakers and investors. There’s room for explosive growth, but also the possibility that the whole industry could be shut down overnight. But booming sales, coupled with little or no trace of negative externalities, is leading states to loosen up a bit, and let the hidden hand work its magic.

For states with planned legal marijuana markets in operation – as of right now, that’s Washington, Colorado, and Oregon (Alaska’s working on it) – the industry has been a boon. Jobs are being created, revenues are being redirected away from street dealers and to voter-approved coffers, and law enforcement agencies are freeing up resources to be used elsewhere.

Just look at the numbers: Colorado alone saw nearly $1 billion in sales in 2015. Experts are projecting the industry nationwide to top $6.8 billion this year. The industry is on fire, and as a result, regulators are easing up a bit.

Take a look at Washington state, which took a much more conservative approach to legalization than Colorado did. Washington put control of its pot laws in the hands of the state’s Liquor Control Board, whose handling has been criticized as being too slow and stringent. But now that we’re a couple of years in, the board is relaxing requirements, and issuing new business licenses to those looking to get into the industry.

Washington also relaxed its taxation policies, which ultimately increased prices of cannabis product at retail stores well-above street value. That meant that instead of going through legal channels, people would still purchase from street dealers, or through (unregulated) medical cannabis dispensaries. But again, we’re seeing the government bodies in control take a more hands-off approach, with lower taxes, and by allowing more businesses to open up.

Colorado’s more liberal approach has attracted more attention, more business, and more revenues. Washington lawmakers are recognizing that, and planning their next moves accordingly.

Washington’s legislators’ caution wasn’t completely unwarranted. From a regulator’s perspective, crafting marijuana policy is tricky. Prior to the 2012 voter-backed initiatives, no one had done it before. So putting together a plan from scratch presented a lot of challenges. Needless to say, legislators stepped lightly, putting together laws that kept the industry on a tight leash.

But we reiterate, Colorado’s laws were a bit less stringent than Washington’s, and as a result, the state saw better results. Other states, like Oregon, took note, and mirrored Colorado’s policies more so than Washington’s when making its own laws. This is ideally how things are supposed to work; it’s the idea of the 50 states acting as laboratories.

What this means for the future of the legalization movement, and for the economy as a whole, is that open, freer markets – in cannabis cultivation and trade, anyway – are clearly winning out over heavy state control. Nobody knew how the legalization “experiment” was going to work out, and the good news is that states (as we’re seeing with Washington) are adapting. Colorado keeps bringing in revenues from fees related to cannabis business licenses, and is better off for it. Washington’s catching up.

Oregon’s industry is still getting off the ground. The Oregon Liquor Control Commission is still in the process of figuring out ways of licensing legal stores, and according to Oregon Public Radio, it looks as though none of the businesses themselves will open up until late this year. Sales are still happening, though, at the state’s medical marijuana shops. Once legal shops open, that will be phased out.

Going forward, with a slew of states on top to legalize (or try to legalize) during this year’s election period, legislators will continue to watch what’s happening out west. We’re seeing states adapt and take a more hands-off approach, which is evidently working to funnel people away from black and gray markets. That’s the biggest issue – if the legal market is too difficult or expensive to access, consumers will go someplace else.

Ohio tried to push through a legalization effort that was heavily regulated – some might say it was cronyism – and the voters didn’t buy it. So, consumers are paying attention, and it seems that people favor open, hands-off approaches from the states.

If states go that route, as it seems most should, consumers, entrepreneurs, and ultimately state legislators should all come out as winners.

A very comprehensive arguement in favor of marijuana legalization

I was surfing Yahoo Answers and came across this. It is the most informative post ever written in favor of marijuana legalization:

I did the government marijuana studies in the 1960's. This was a controlled study that lasted 3 months. They set up two societies that were kept apart. One side smoked placebos and one side smoked what I would now consider mediocre pot. The smoker side was found to be more industrious and creative.

Pot is NOT harmful to the human body or mind and does NOT pose a threat to the general public. Marijuana is very much a danger to the oil companies, alcohol, tobacco industries and a large number of chemical corporations. Various big businesses, with plenty of dollars and influence, have suppressed the truth from the people.

If marijuana was utilized for its vast array of commercial products, it would create an industrial atomic bomb! Entrepreneurs have not been educated on the product potential of pot. The elite have conspired to spread misinformation about an extremely versatile plant that, if used properly, would ruin their companies. :

For thousands of years, 90% of all ships' sails and rope were made from hemp. The word 'canvas' is Dutch for cannabis. 80% of all textiles, fabrics, clothes, linen, drapes, bed sheets, etc. were made from hemp until the 1820s with the introduction of the cotton gin.

The first Bibles, maps, charts, Betsy Ross's flag, the first drafts of the Declaration of Independence and the Constitution were made from hemp; U.S. Government Archives.

In 1916, the U.S. Government predicted that by the 1940s all paper would come from hemp and that no more trees need to be cut down. Government studies report that 1 acre of hemp equals 4.1 acres of trees. Plans were in the works to implement such programs; Department of Agriculture

Henry Ford's first Model-T was built to run on hemp gasoline and the CAR ITSELF WAS CONTRUCTED FROM HEMP! On his large estate, Ford was photographed among his hemp fields. The car, 'grown from the soil,' had hemp plastic panels whose impact strength was 10 times stronger than steel; Popular Mechanics, 1941.

Mechanical Engineering Magazine published an article entitled 'The Most Profitable and Desirable Crop that Can be Grown.' It stated that if hemp was cultivated using 20th Century technology, it would be the single largest agricultural crop in the U.S. and the rest of the world.

In the 1930s, innovations in farm machinery would have caused an industrial revolution when applied to hemp.. Hemp, if not made illegal, would have brought America out of the Great Depression.

William Randolph Hearst and the Hearst Paper Manufacturing Division of Kimberly Clark owned vast acreage of timberlands. The Hearst Company supplied most paper products. He stood to lose billions because of hemp.

In 1937, Dupont patented the processes to make plastics from oil and coal. Dupont's Annual Report urged stockholders to invest in its new petrochemical division. Synthetics such as plastics, cellophane, celluloid, methanol, nylon, rayon, Dacron, etc., could now be made from oil. Natural hemp industrialization would have ruined over 80% of Dupont's business.

Andrew Mellon became Hoover's Secretary of the Treasury and Dupont's primary investor. He appointed his future nephew-in-law, Harry J. Anslinger, to head the Federal Bureau of Narcotics and Dangerous Drugs. Secret meetings were held by these financial tycoons. Hemp was declared dangerous and a threat to their billion dollar enterprises. For their dynasties to remain intact, hemp had to go. These men took an obscure Mexican slang word: 'marihuana' and pushed it into the consciousness of America.

A media blitz of 'yellow journalism' raged in the late 1920s and 1930s. Hearst's newspapers ran stories emphasizing the horrors of marihuana. The menace of marihuana made headlines. Readers learned that it was responsible for everything from car accidents to loose morality. Films like 'Reefer Madness' (1936), 'Marihuana: Assassin of Youth' (1935) and 'Marihuana: The Devil's Weed' (1936) were propaganda designed by these industrialists to create an enemy. Their purpose was to gain public support so that anti-marihuana laws could be passed.

Examine the following quotes from 'The Burning Question' aka REEFER MADNESS: a violent narcotic, acts of shocking violence, incurable insanity, soul-destroying effects, under the influence of the drug he killed his entire family with an ax, more vicious, more deadly even than these soul-destroying drugs (heroin, cocaine) is the menace of marihuana!

In the 1930s, people were very naive; even to the point of ignorance. The masses were like sheep waiting to be led by the few in power. They did not challenge authority. If the news was in print or on the radio, they believed it had to be true. That has been the downfall of America. Innocence used against itself. These people kept the stories alive and told their children. Here we are today.

Congress banned hemp because it was said to be the most violence-causing drug known. Many great problems could be reversed if we industrialized hemp. Natural biomass could provide all of the planet's energy needs that are currently supplied by fossil fuels. We have consumed 80% of our oil and gas reserves. We need a renewable resource. Hemp could be the solution to soaring gas prices.

Hemp has a higher quality fiber than wood fiber. Far fewer caustic chemicals are required to make paper from hemp than from trees. Hemp paper does not turn yellow and is very durable. The plant grows quickly to maturity in a season where trees take a lifetime.

ALL PLASTIC PRODUCTS SHOULD BE MADE FROM HEMP SEED OIL. Hempen plastics are biodegradable! Over time, they would break down and not harm the environment. MEDICINES SHOULD BE MADE FROM HEMP. We should go back to the days when the AMA supported cannabis cures. 'Medical Marijuana' is given out legally to only a handful of people while the rest of us are forced into a system that relies on chemicals. Pot is only healthy for the human body.

WORLD HUNGER COULD END. A large variety of food products can be generated from hemp. The seeds contain one of the highest sources of protein in nature. ALSO: They have two essential fatty acids that clean your body of cholesterol. CLOTHES SHOULD BE MADE FROM HEMP. Hemp clothing is extremely strong and durable over time. There is only one enemy; the friendly people you pay your taxes to; the war-makers and nature destroyers. With your funding, they are killing the world right in front of your eyes. HALF A MILLION DEATHS EACH YEAR ARE CAUSED BY TOBACCO. HALF A MILLION DEATHS EACH YEAR ARE CAUSED BY ALCOHOL. NO ONE HAS EVER, EVER DIED FROM SMOKING POT!! In the entire history of the human race, not one death can be attributed to cannabis.

Our society has outlawed grass but condones the use of the KILLERS: TOBACCO and ALCOHOL. Hemp should be declassified and placed in DRUG stores to relieve stress. Hardening and constriction of the arteries are bad; but hemp usage actually enlarges the arteries.which is a healthy condition. We have been so conditioned to think that: Smoking is harmful. That is NOT the case for passive pot.
Ingesting THC, hemp's active agent, has a positive effect; relieving asthma and glaucoma. A joint tends to alleviate the nausea caused by chemotherapy. You are able to eat on hemp. This is a healthy state of being.

The stereotype for a pothead is similar to a drunk, bubble-brain. Yet, the truth is one’s creative abilities can be enhanced under its influence. The perception of time slightly slows and one can become more sensitive. You can more appreciate all arts; be closer to nature and generally FEEL more under the influence of cannabis. It is, in fact, the exact opposite state of mind and body as the drunken state. You can be more aware with pot.

The next time you are arguing with a prohibitionist or two (or more) hit them with this puppy and see if they can refute it. They can't so it should shut them up. This way they can't spew their lies.

If you wish to make you're elected officials in the House and Senate aware of this post you are highly encouraged to do so. I did so go for it. In fact everybody go for it and cause some real change. The biggest prohibitionists in the Senate: Senator Dianne Feinstein and Senator Chuck Grassley should be contacted as well. Politely but firmly tell them that they are out of touch with the wishes of the American people and that the people support marijuana legalization.

The rainbow mafia plans to destroy religious freedom

Christian daycares could be forced to hire transsexuals.

And this is merely a glimpse of what's to come if we allow the Homosexual Lobby to execute their radical agenda.

I am not going to lie to you, stopping them won't be easy.

The Homosexual Lobby marches through the halls of Congress daily.

They twist arms and make campaign promises to weak-kneed politicians who will support their radical agenda and betray Religious Liberty.

With everyone’s attention on the elections, they are working behind the scenes to set this up for quick passage. That’s why it’s so important that we get loud and call out the TPP for corruption now.

Tell your elected leaders to defund the DEA

Recently the DEA held a Kangaroo court of a discussion concerning rescheduling marijuana from Schedule 1,where the drugs in this category have no medicinal value although with marijuana we know that is not true,to the less restrictive Schedule 2. The DEA was lobbied by the people of the United States of America whom demanded that marijuana be rescheduled to Schedule 2. I don't know if the DEA decided to pull a fast one from the beginning or this was a recent development but they decided against rescheduling. Jesse Ventura discusses the decision by the DEA and how they fucked with us. I'm sure they got a good laugh with their little game of "let's yang their chains and see what happens." I want us to have a good laugh too. The best way we can do that is to contact our Congressperson and Senators and demand the DEA be defunded. If they want to deny people marijuana in defiance of the wishes of the people then the people do not want to pay their salaries. Why should the people pay their tormentors? The DEA,along with the rest of the federal government work for us,The People. Let's remind them of that. The more of us they hear from the better so let them know.

Don't let big cable sell your private information

This is a story of cynical Beltway politics at its worst.

FCC Chairman Tom Wheeler has two strong proposals on the table: one would stop Comcast from selling your private information without your consent, and another would lower your cable-TV bill by ending the monopoly on that set-top box you're forced to rent each month.

Thousands of us have written in support of these common-sense, pro-consumer policies — but it isn't clear whether they'll move forward before the end of the Obama administration.

The cable industry's friends in Congress are threatening the survival of both of these measures. Instead of letting the agency do its job, they're pressuring Wheeler to resign right after the election and stalling the renomination of Commissioner Jessica Rosenworcel.

Holding up a confirmation to force the agency's hand on unrelated topics is no way to govern.
Worse still: It might be working.1

Rosenworcel is reportedly reluctant to move quickly on these crucial measures. And they need her vote to pass.

Tell Obamq to stand with the people not trial lawyers.

- This proposed regulation isn’t about protecting consumers, it’s designed to make it easier for trial lawyers to gather big class action groups allowing them to collect bigger fees.

- The government’s own study found that individual arbitration awards average several thousand dollars, while the average class action settlement payment is $32.35. Meaning that consumers and victims are better off in arbitration.

- This rule will make all covered financial products more expensive: higher fees for bank products, higher interest rates on credits cards. And this rule only benefits trial lawyers.

So far, we’ve been able to drive more then 10,000 comments to stop it. But I fear it won’t be enough. If we’re going to stop this terrible regulation we need to double that amount. Why are police officers being targeted?

That's the question a lot of conservatives are asking. They keep asking and asking but unfortunately for them I'm going to answer them with a response they are going to hate. Police brutality. Let's use former police officer current prison inmate Drew Peterson as an example. Peterson was recently caught trying to hire a hitperson to kill the prosecutor that sent him to prison. When he was an active police officer Peterson was known to threaten those he stopped. When he wrote speeding tickets or other infractions he told the people being cited that they better plead guilty or he would make their lives a living hell. Drew Peterson was a dirty cop but there are other dirty cops out there and the police brass covers for them. If a bad cop shoots someone and kills them they get time off with pay. If you or I do the same thing we go to jail and possibly prison. Sean Hannity loves to have on his show Milwaukee County Sheriff David Clarke.Hannity throws softballs Clarke's way. Let me ask Clarke the question on dirty cops and what he is doing to combat the problem. That is if they are doing anything about it. I'll ask him the tough questions like: the blue code is never snitch on a fellow cop. The prison code is never snitch on a fellow con. What is the difference between these two codes and what is he doing to address the problem of police brutality? For every action there is a reaction. Police brutality begets violence against police officers. the people are going to rebel against oppressive authority. When the people see bad cops being ostracized and shunned then perhaps things can settle down. When these same officers go to prison for their misdeeds then maybe the problem will dissipate. But there have to be reforms before anything can progress forward.

You must really hate America. I guess the party takes a backseat to your egos. The fact that you are not supporting Donald Trump for President speaks volumes. I guess you have no problem with a Hillary Clinton Presidency. I guess you have no problem with Hillary picking the next Supreme Court justice. The person she nominates will not share your values. In fact just like Hillary they will despise them. Hillary will stack the Supreme Court with very liberal judges that will rip to shreds the Constitution, the document you give lip service to by lying when you say you love the Constitution and honor it. If you support and vote for Hillary you are a traitor. A traitor to the things you claimed to have loved and honored but the moment you didn't get your own way you are ready to throw away America just to salvage what is left of your precious pride. "I'm taking my toys and going home" is what you are basically saying. The American people have chosen Donald Trump as the Republican Party's nominee for President of the United States of America. The will of the people is everything while you egos are shit. Get used to it and support Donald Trump for President.

Support Rock Against The TPP

I’m really worried. Our Rock Against the TPP tour has been generating widespread public outcry, but President Obama just said that he’s still planning to try to ram the Trans-Pacific Partnership (TPP) through Congress after the election.

We’re plotting with some major celebrities for a final showdown, a huge educational concert / protest in Washington, DC that will generate massive media attention and help make the TPP too politically toxic to pass. Right now we’re less than $20,000 short of the budget we need to make this happen. Pressure the House Republicans to impeach IRS Commissioner John Koskinen
